When you hire Translocal’s services you are agreeing to these terms, so read them carefully.

TERMS OF SERVICE (In plain English)

Translocal provides its services subject to the following terms of service.

1. Insurance & liability

If you require your goods to be insured while in transit then you are responsible for arranging your own goods in transit insurance.

Translocal is not a Common Carrier and as such will accept no liability for any loss or damage to goods being transported howsoever caused. All goods are carried or transported and all other services are performed by Translocal subject only to these terms and Translocal reserves the right to refuse the carriage or transport of goods for any person or corporation and the carriage or transport of any class of goods at its discretion.

This is not saying that you can’t have your goods covered. Just that you are responsible for arranging your own insurance. There are a number of insurers that provide goods in transit insurance but we do not recommend any particular insurer.

2. Quotes & payment

All jobs will be quoted in advance and must be paid for at delivery unless otherwise agreed during booking. Translocal provides a range of payment options for your convenience. For more details see our Pricing page.

3. Our responsibilities

To take reasonable care to protect and safeguard the goods;

To provide the carriage of goods exercising the degree of skill, care and efficiency that would be expected from a competent service provider experienced in providing carriage of goods;

To obtain and maintain at our own expense all proper and necessary licences as may be required by law in connection with the provision of the carriage of goods;

To use reasonable endeavours to deliver the goods to the address nominated by the customer and to effect delivery at the date and time requested by the customer (subject to compliance with all applicable laws, including Chain of Responsibility Law); and

To use reasonable endeavours to comply with the customer’s reasonable and lawful directions.

4. You warrant that;

You have the authority of all persons owning or having any interest in the goods to accept these terms on their behalf.

the details of description, items, pallet space, quantity, weight, volume, quality, value and measurements supplied by you or any other party are correct.

there is a suitable practicable road and approach for Translocal and Translocal’s vehicles to the place from which the goods are to be collected and the place to which the goods are to be delivered.

5. Dangerous goods

We do not transport dangerous goods. So if it burns, explodes or corrodes then it’s a no-go. You have a duty to advise us if anything within your load may be dangerous goods as soon as you become aware of such.

6. Goods should be ready to transport

Goods and items that are being transported should be appropriately packaged, palleted, boxed, bagged, disassembled if necessary and ready to be transported when we arrive. For example, rather than having many small loose items that would be difficult to restrain and might blow out of the tray and be lost, these items should be boxed or bagged and the box/bag taped or tied shut.

As a further example, a timber or steel frame bed to be transported should be disassembled into its individual components (head, foot, side rails, slats etc). If you need help to disassemble or reassemble furniture that you need to have transported please let us know in advance so we can arrange to bring the required tools and equipment with us.

In particular, for tip runs any loose rubbish items should be bagged in garbage bags and ready to transport. To be clear, we provide a transport service, not a cleaning service so we will happily transport your waste to the tip but we don’t clean up and bag the rubbish for you. This should be done before we arrive.

7. Load/unload assistance

Usually our vehicles are operated by one person so our driver may need assistance to load and unload heavy items. If there are heavy (two man lift) items in your load and it is not possible for you to provide this assistance don’t fear. We can provide a second team member and do all the heavy lifting for you. In these situations we have to charge an additional $30 per hour.

8. No guarantee as to condition or suitability of goods

If we are transporting and delivering goods that you have purchased and in particular if you have not inspected the goods prior to purchase please understand that we do not inspect goods on your behalf or guarantee the goods as to their condition, suitability for a particular purpose or whether the goods are as advertised. Our job is simply to collect and deliver the goods. Any subsequent dispute over the condition or suitability etc of the goods is between you and the seller/supplier of the goods. You are not entitled to withhold any part of monies owed to Translocal in relation to any such dispute.

9. Deviation from route

The Customer authorises any deviation from the usual route or manner of Carriage of Goods that may in the absolute discretion of Translocal be considered desirable or necessary in the circumstances.

10. Incidentals

The customer is responsible for incidental costs and disbursements such as tolls, ferry fares and overnight accomodation (although I can’t remember the last time I went so far from home that I needed to camp out for a night).

11. You will indemnify Translocal;

in respect of any liability whatsoever in respect of the Goods to any Person (other than you) who claims to have, who has, or who in the future may have any interest in the Goods or any part of the Goods and against all losses, damages, claims, fines, expenses, duty, tax, demands, actions and proceedings or any other liability suffered or incurred by, or made or instituted against, Translocal as a result, directly or indirectly, of;

a breach of your obligations under these terms

the nature or condition of the Goods; or

any negligence, wilful misconduct or recklessness by you.

12. Force majeure

Translocal will not be liable for any failure or delay in performance of the Carriage if such failure or delay is due, in whole or in part, to any cause whatsoever beyond its control including but not limited to acts of God, lightning, earthquakes, cyclones, floods, landslides, storms, explosions, fires and any natural disaster, acts of war, acts of public enemies, terrorism, public disorder, riots, civil commotion, malicious damage, vandalism, sabotage and revolution, explosions and nuclear accidents, strikes, labour disputes and other industrial disturbances, any road closure or congestion of roads, any quarantine or customs restriction, any interruption of power supply or scarcity of fuel or any accident, collision or breakdown of a vehicle, machinery or equipment.

13. Governing law

These terms are governed by the laws of Victoria and all parties submit to the jurisdiction of the Courts of Victoria.

14. Severability

If any part of these terms is deemed invalid or un-enforceable, that part will (if possible) be read down to the extent necessary to avoid the invalidity or un-enforceability, or alternatively that part will be severed from these terms and the remainder of these terms will remain otherwise in full force.

15. General

Headings are included for convenience only and do not affect interpretation of these terms.

Words importing the singular include the plural and vice versa and words importing a gender include other genders.

The indemnities in these terms survive the termination or expiration of any agreement that incorporates these terms.

16. Changes and updates

These terms are subject to change without notice. It is up to you to check and be aware of the current terms. These terms were last updated on 9 Feb 2023.

We quote in advance

Our rates are calculated partly on distance and partly on time. We use Google maps to find the distance between the pickup and delivery points so we can quote in advance. So usually you will know in advance what the job will cost. Sometimes there might be a possible variable in the cost if we can’t be certain how long the job will take but usually you will know. We collect and deliver your goods

We collect and deliver your goods as agreed and of course we take the greatest care. Because our vehicles are operated by a single driver, if any of the items are a two man lift then you may need to provide assistance to load and unload. If you can’t provide this assistance then we can arrange a second team member but will need to charge extra for this. Find out more about our rates here.

Why should I use Translocal and not just hire a trailer or a ute?

Because for shorter more local jobs we are usually less expensive than trailer or ute hire but even when we are not, you don't have the hassle of picking up and returning the trailer or ute. Plus you have our help to get the job done.

Do you only operate in Melton or do you service other areas?

We used to say that a job would need to start in, end in or pass through Melton but we will go outside our operating area if the customer is prepared to pay a little extra to cover the dead (unpaid) miles we would need to travel. The best way to find out is ask.

If I buy an item say, in the Facebook marketplace and hire Translocal to deliver it, can I get you to pay for the item and fix you up when you deliver?

Not yet! For the moment the purchase of the item is between you and the seller, we only deal with delivery. But we might have something in the pipeline. Watch this space.

What payment methods do you have?

Our drivers are equipped with mobile EFTPOS terminals which means you can pay using your credit or debit card or even with your mobile phone if you use Apple Pay or Google Pay. We also have the ability to send you an invoice by email which you can pay securely online from the comfort of your own computer or smart phone and of course we also accept cash.
